עדכון חקיקה – תקנות דמי מחלה

ביום 1.9.2024 ייכנס לתוקף תיקון לתקנות דמי מחלה (נהלים לתשלום דמי מחלה) (תיקון), התשפ"ד-2024.

בהתאם לתיקון, ומתוך מגמה להקל על העומס המוטל על הרופאים, נקבע כי עובד יוכל להמציא למעסיק תעודת מחלה שאינה חתומה על ידי רופא, וזאת במתווה המפורט להלן:

  1. מדובר ב"תעודת מחלה קצרה", לפרק זמן שאינו עולה על 4 ימי מחלה, שניתן שלא בעקבות ביקור רופא או שיחה עמו או היועדות חזותית עמו, ושאינה תעודת מחלה שניתנה במקרים רפואיים חריגים.
  2. תעודת מחלה קצרה לא תינתן יותר מארבע פעמים בשנה, כאשר תעודות שהונפקו בטווח של 7 ימים יראו אותן כתעודת מחלה אחת, ולא תינתן אם וככל שבשבעת הימים שקדמו לאישור האמור ניתנו לעובד תעודות מחלה קצרות בעד יותר מארבעה ימי מחלה.
  3. עוד נקבע כי לא תינתן תעודת מחלה קצרה לגבי פרק זמן מצטבר של יותר מעשרה ימים בשנה.
